Legal angst between two Chicago glazing companies continue to unfold. On March 17, Talon Wall Holdings, Entekk Group Ltd. and Chicago Heights Glass amended their complaint in the case against Reflection Window & Wall (RWW), Joel Phelps, Pepper Construction Co., Provident Group UIC Surgery Center, Lendlease Construction Inc., 1400 Land Holdings and others, for alleged patent infringement.
The amended complaint lists four counts of the defendants’ alleged patent infringement. The first and third counts claim infringement of U.S. patents dealing with the façade system in question. The second count alleges infringement on U.S. patents regarding installation methods, and the fourth alleges patent infringement of the RWW system.
In December 2021, the plaintiffs filed a federal patent infringement lawsuit citing four counts against the defendants, including former employee Phelps. The original documents state the patented exterior aluminum and glass wall construction system for commercial buildings, known as Talon Wall®, has been incorporated in Phelps’ and RWW’s building façade system “UWall” or “U-8000.” The lawsuit further alleges the defendants knowingly violated the Talon Wall patents. RWW’s website advertises the UWall system acknowledging it is based on the Talon Wall System, according to the documents, where it is described as having “exceptional invention and parentage.”
In light of the filing of the amended complaint, Judge Charles Kocoras denied and deemed moot the defendants’ Motion to Dismiss filed at the end of February. A telephonic status hearing is scheduled for April 28 at 10 a.m.
