The Federal Appellate court has dismissed a patent case brought forth by Green Mountain Glass LLC against Ardagh Glass Inc., formerly Saint-Gobain Containers Inc., leaving in place an April 2017 Delaware jury verdict.

Green Mountain Glass alleged in its appeals case that Ardagh infringed upon two of its patents involving glass recycling. In the original U.S. District Court for the District of Delaware case, the jury returned a verdict in favor of Green Mountain Glass, but only for one of the patents (US5718737A, Method of recycling mixed colored cullet into amber, green, or flint glass). The judgment ordered Ardagh to pay Green Mountain Glass $50.3 million. In the appellate case, Green Mountain Glass sought extra damages while Ardagh sought to reverse the judgment. However, the three-judge panel shot down the case, affirming the jury’s decision.
