An Indiana man has filed a lawsuit against a local YMCA, saying the organization’s negligence played a part in his crashing through a glass window and suffering “severe bodily injuries” while playing tennis earlier this year.

In papers filed with Indiana’s Delaware Circuit Court No. 1, Brandon Smith alleges that the YMCA in Muncie, Ind., and its president, Cathy Clark, failed “to provide a safe tennis playing area,” leading Smith “to slip and go through a glass window” when the incident occurred in February of this year.

Efforts to reach Smith or his Indianapolis-based attorney, Jenice Golson-Dunlap, had been unsuccessful at press time.

The lawsuit, which was filed on December 11, seeks unspecified damages to cover Smith’s “physical and emotional expenses,” while also requesting compensation for related medical and prescription expenses.

Neither Clark nor Indianapolis-based attorney, Keith A. Kinney, who represents both her and the YMCA, could be reached for comment.

The defense has until February 8 to respond to the complaint, court records show.

A court hearing on the matter has not yet been scheduled.
